1. Agreeing to These Terms

By using or purchasing any service from Ephraim Creations , you agree to these Terms of Service and our Privacy Policy. These terms guide how we work together in web design, branding, digital marketing, and more.

2. What We Offer

We provide a wide range of creative and digital services, including:

• Website design and development (WordPress, Wix, HTML)
• Logo and brand identity design
• Online (virtual) consultation
• Marketing materials like posters, brochures, and social media graphics
• SEO and social media management
• Setting up online shops and eCommerce platforms
• Selling digital products such as eBooks and online courses

Note: Project timelines, deliverables, and revision limits will be clearly outlined in your invoice or service agreement.

3. What We Expect From You

To ensure smooth collaboration and quality outcomes, please:

• Provide all necessary content (text, images, etc.) in good time
• Respond to feedback requests and approvals promptly
• Make payments as agreed
• Refrain from submitting false, misleading, or illegal content

4. Your Data and Privacy

Your privacy matters to us. In line with Kenya’s data laws:

• Your data is stored safely and securely
• We will never share your data without your permission
• We use third-party tools responsibly and with care
• We do not sell or trade your personal information

5. Revisions and Final Files

Each package comes with a limited number of revisions:

• Basic Plan: Up to 2 revisions
• Plus Plan: Up to 4 revisions
• Premium Plan: Up to 5 revisions

Extra changes or requests outside the original scope may involve additional charges. Final files will be delivered in the formats we agreed upon at project start.

6. What You Can’t Do

You agree NOT to:

• Resell, redistribute, or repackage our work (e.g., templates, eBooks) without permission
• Use our services or deliverables for any illegal or unethical purposes
• Claim credit for our work in cases where attribution is required
• Engage in abusive, threatening, or unprofessional communication

7. Important Notices

Please keep in mind:

• Marketing or SEO results may vary depending on industry and timing
• Project success depends on timely communication and collaboration from both sides
• We are not liable for issues caused by third-party platforms (e.g., hosting, social media, or payment providers)

8. Payment & Refund Policy

We follow a simple payment structure: 50% upfront, 50% upon completion.

• We begin work only after the initial deposit is received
• The deposit is refundable if a client want to terminate the project before it starts.
• The 50% deposit is not fully refundable once work starts. An initial labour cost is charged.
• You are encouraged to request revisions if unsatisfied—final payment is due before file delivery
• Refunds are not issued after final files are delivered
• Please report any concerns within 5 days of receiving the final work
• For digital products (eBooks, courses, consultations), full payment is required on the day of purchase

9. Legal Matters

These terms are governed by the laws of Kenya. Any disputes will be handled in Kenyan courts, under applicable legal procedures.

10. Updates to These Terms

We may revise these Terms of Service from time to time. Any updates will be posted here. If there are major changes, we’ll notify you via our website or email.
